Scrap metal dealers act 2013
The law regarding scrap metal dealers and motor salvage has changed. New legislation called the Scrap Meal Dealers Act 2013 has now been introduced.
The new legislation requires that any persons collecting or buying scrap in Bassetlaw requires a Scrap Metal Dealer Licence issued by us. The new legislation has replaced the old Scrap Metal Dealers Act 1964 and also the Motor Salvage Operators regulations 2002. The new Act give Local Authorities more powers of control, for example refusal of a Licence or revocation of a Licence if the dealer is considered “unsuitable” or the operators are not abiding to the legislative requirements of their application. The Police and Local Authorities now have powers of entry for inspection of a scrap metal premise.
Types of licence
Site Licence
This is required where a business operates in scrap metal at a premise. A Site Manager is to be required to be named for each site. The licensee will then be permitted to operate from that site as a scrap metal dealer including transporting to and from those sites from any local authority area. The fee for this Licence will be £368.00 for a three-year Licence and £301.00 for a renewal thereafter.
Collector’s Licence
This authorises the licensee to operate as a mobile collector in the area of the issuing local authority, permitting them to collect scrap metal as appropriate. This includes commercial as well as domestic scrap metal. If a mobile collector operates within more than one local authority’s district, a licence will be required for each authority that he/she operates in. The fee for this Licence will be £130.00 for a three-year Licence and £130.00 for renewal thereafter.
Provisions of the new act
Provisions of the new Act include the following:-
- The requirement for Scrap Metal Dealers to satisfy their local authority that they are a legitimate trader.
- All sellers of metal must provide verifiable ID at point of sale which is recorded and retained by the dealer.
- Cash must no longer be given as payment for scrap metals. Sellers must be paid by cheque, BACS (or another traceable method). This will now apply to all collections of scrap metal.
- There will be a single national publicly available register of all scrap metal dealers.
Under the new act we must not issue a Licence unless we are satisfied that the applicant is a suitable person to carry on the business as a scrap metal dealer. You will therefore need to submit a basic criminal record disclosure form as part of the application process. Basic Disclosure certificates can be obtained online through Disclosure & Barring Service.
Please note these new Scrap Metal Dealers 2013 Licences do not replace the Waste Carrier’s Licence. To deal in and collect scrap in Bassetlaw you will therefore be required to hold a Licence issued by us for scrap metal and also a Waste Carriers Licence that is issued by the Environment Agency.
