What are land charges?

Local land charges

We joined the digital Local Land Charges service managed by HM Land Registry (HMLR) in October 2021 and that service now provides LLC1 search responses. You can access HMLR searches via the new digital service through your portal account, Business Gateway and on GOV.UK.

We continue to provide CON29 responses to our customers on payment of the appropriate fee.  Search requests can be made using the National Land Information Service (NLIS) or direct to us (including payment). Please see our Con29 Search Information.

Why do I need a Con29 search

Buying a House can prove to be the most expensive, frustrating item you may ever purchase. Bassetlaw District Council can:

  • Complete Con29 searches within 5-10 working days.
  • Carry out a fast, accurate service by skilled, professional, fully trained staff.
  • Searches are accepted by all mortgage lenders.
  • Ensure that all information needed to compile a search is held and maintained by the Council.
  • Ensure that there are links to internal and external departments who can quickly get information.
  • Include a complete search history.
  • Ensure that every question on the *Con29(R) and *Con29(O) will be answered comprehensively with details of where further information can be obtained.

All Official Con29 Searches are covered by the Council's comprehensive insurance.

A tracking service where you can contact the Land Charges staff to find out the progress of your search is available.

The Ministry of Housing, Communities and Local Government has published guidance for the public on “How to buy a home” and “How to sell a home”. This guidance has been developed following meetings last year with stakeholders including the Local Land Charges Institute.

Note: * A Con29 is the Official Enquiry Search Form that is compiled of standard set questions by the Law Society. The Official Search is certified by the Council and the Land Charges Act 1975. The search is completed by trained Council staff and contains information regarding Planning Permissions, Tree Preservation Orders, Listed Buildings, Road Agreements and Schemes to name a few. All of which is vital information whether you are buying or selling a house.

Environmental Information Request (EIR)

Bassetlaw District Council will continue to provide the service of the CON29 responses, on receipt of an appropriate fee. 

The CON29 search requests can be made using the National Land Information Services (NLIS), or, by submitting your Con29 directly to Land Charges Unit, Bassetlaw District Council, Queens Building, Potter Street, Worksop, Notts S80 2AH, or online Land.charges@bassetlaw.gov.uk

Land Charges – EIR requests

Should your EIR request relate to Land Charges CON29 enquiries, it is important that you supply a map clearly identifying the extent of the area you are enquiring about?

Information provided under EIR is raw data and may include data concerning neighbouring land.  It is your responsibility to check the data provided and decide if it is relevant or not, requests for information under EIR will be dealt with as soon as possible but may take up to 20 working days.

The Council is not provided with copies of completion certificates or notices issued in respect of work carried out (including works under Competent Person (self-certification) Schemes).

Notices that have been served, made or commenced will be held either on the Local Land Register (HMLR), the Planning Register or anything relating to the  Enforcement Register Planning email foirequests@bassetlaw.gov.uk

3.10 (a) Community infrastructure levy (CIL)

3.10 (b - h) Community infrastructure levy (CIL)

On the 1 September 2013 the Bassetlaw District Council Community Infrastructure Levy (CIL) Charging Schedule came into effect. To find out more information about what development will be liable to CIL please visit our Community Infrastructure Levy (CIL) pages.

If CIL is a requirement for an approved development this will be recorded on the Land Charges Register and disclosed to interested parties on receipt of an Official Search. This is the case for any Enforcement Actions taken in respect to the CIL.

3.11 (a) and (b) Conservation areas
Details of all conservation area maps, including designation dates, maps and those under review (including unimplemented resolutions to designate new conservation areas) is available on our Conservation Area website.

3.12 Compulsory purchase
This information is not available via a public register. Please submit your EIR request to EIR request 

Our response does not include other bodies such as Nottinghamshire County Council, Secretary of State and Utility Companies who have Compulsory Purchase Order powers. You are advised to contact these for further information.

3.13 Contaminated land
Information is available on our Contaminated Land public register website. You may view the contaminated land register during the normal office hours. Monday to Friday 9am until 5 pm

3.14 Radon gas
This information can be obtained from UK Health Security Agency website.

3.15 (a - b) Assets of Community Value (ACV)
Details of our register of both current and unsuccessful ACV's are available on the Councils Website.

Important – CIL Liability is held as a Charge on Land.  If CIL is not paid you may have difficulty selling your Land or Property.

Public Registers

Local land charges access to Con29 information

From the 1st April 2020 all the below information contained on a Con29 will be available for any person wishing to carry out a Personal Search and other Con29 information should be sought under the EIR channel for which you are required to contact the Council’s EIR Officer directly.

Planning Public Register

Planning site histories can be viewed in the reception area so long as you have requested the information in advance all information must be returned to the Reception Desk To request Planning information please contact the Planning Department on 01909 533 533 or write to the Planning Department, Queens Buildings, Potter Street, Worksop, Notts. S80 2AH. Some information is available on the Council’s Public Register.

Enforcement Public Register

Please contact the Planning Department for an appointment to see any information regarding Enforcement Notices on 01909 533 533.

Local Plan

The Local Plan can be viewed in the Council’s Reception on request or alternately paper copies are obtainable at a cost of £55.00 on collection or £60.00 posted. For information regarding the Local Plan please contact the Planning Policy Manager on 01909 533 533.

Contaminated Land

Please make an appointment to view the Contaminated Land Register by contacting the Environmental Health Team on 01909 533 533.

Radon Gas

Public Health England - UKradon hold information regard radon gas. Public Health England (PHE) was formed in April 2013 when a number of existing organisations, including the Health Protection Agency, were brought together to form a single authoritative health protection body. PHE is an executive agency of the Department of Health.

Highways Information (including Nearby Railway Schemes)

All Highways Information is held by the Nottinghamshire County Council.

Public Rights of Way

Public Rights of Way can be obtained from the Nottinghamshire County Council.

Drainage Information (SUDS)

Question 3.3 (a)(b) & (c) As schedule 3 of the Floor and Water Management Act 2010 has not been brought into force, the Council is not required to keep any records regarding sustainable drainage systems, maintenance responsibilities or surface water drainage charges for any individual properties.

One-Stop Shop Facility

The Land Charges Staff are not available to clarify any details regarding the information held on any public registers or EIR information. It is at the discretion of the personal searcher to follow up with the relevant departments any queries that may arise from data sourced.

Alternatively you can obtain a full Con29 Search, which will be carried out by the Councils Land Charges Staff at a cost of £123 within 5 – 10 working days.
